一個似乎找不到出口的.....疑惑... ...
一早起來,習慣性開電腦、漱洗,喝水,然後開始bla..bla....bla.........,突然,在經常出沒的位置我找不到我自己,頓時恍然大悟!原來,部落格的人氣指數,是人為操縱出來的呀,原來,一直以來,我並沒有像我以為的.....人氣大有進步嘛?是這樣嗎?是這樣嗎?原來,原來,什麼東西;有形的;無形的.....都是可以操控的,原來,這裡的一切,變得虛假不真實了!那........這裡還有什麼東西,是我可以相信的?
慢慢地,我步上了另一段階梯
沒人告訴我該如何做?往哪走?
我不過隨著自己的意念起舞

Within the copyright law there is a clause for copyrighted property to be used under Fair Use. It is defined on Wikepedia
as follows:Fair use is a doctrine in United States copyright law that allows limited use of copyrighted material without requiring permission from the rights holders, such as use for scholarship or review. (Wikepedia)In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include—
1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
2. the nature of the copyrighted work;
3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
4. the effect of the use upon the potential market for or value of the copyrighted work.
To be sure; this is not a clear cut system for determining what can and cannot be considered in fair use. After reading many articles on the subject here is what I found them to say in common.Hard Facts
1. The Fair Use clause of copyright law may allow you to post an image for scholarship or review of that particular image. You cannot use the image in context with other subjects or topics.
2. If you are not posting the image for profit ( you are not generating ad or sponsorship dollars for your blog) and are posting it for educational or informational purposes you may fall under the fair use umbrella.
3. The only way you can truly find out if you are in violation of someone’s copyright is for them to sue you and win. Until a judge makes a determination it’s innocent until proven guilty.Links to articles on copyright law for bloggers
1. You could technically be in violation of the copyright if you post a photograph taken by any other source other than yourself for any purpose other than critique of the image without the express permission of the photographer of that image. Listing or linking to the source do not put you in compliance.
2. When posting images scanned from books or magazines the copyright is usually held by the publisher. Posting photos for any other purpose than the direct critique of the book or magazine article could be considered infringement. Using the image in the context of an example of a separate topic could be considered infringement.
3. If you copy images from other blogs that are taken by individual bloggers and post them without the owners permission you may be in violation. Linking back or simply posting the source do not protect you.
4. Posting a “disclaimer” on your blog will not excuse you from violations.
Tips to keep you out of trouble
1. Whenever possible get permission
2. When permission is not possible always give credit and link back
3. Do not copy anything in its entirety. Only use as much as you need to get your point across.
4. If possible notify the person whose images you are using that you have posted about them.
This usually leads to good relationships and the person linking back to your blog bringing you new viewers.
5. Be courteous and respectful when using other peoples images
6. If someone complains, take the image down immediately and if need be, post an apology.
I believe that we will see a serious crackdown in the next couple of years on online copyright infringement. However, there are many cases before the courts right now debating the public's right to free expression on the Internet so we will have to wait and see what happens. Please keep in mind I am only expressing my opinion and I am not a lawyer. If you have any questions about copyright law you should seek professional advise. Renowned French designer Philippe Starck says he is fed up with his job and plans to retire in two years, in an interview published in a German weekly on Thursday.
"I was a producer of materiality and I am ashamed of this fact," Starck told Die Zeit weekly newspaper.
"Everything I designed was unnecessary.
"I will definitely give up in two years' time. I want to do something else, but I don't know what yet. I want to find a new way of expressing myself ...design is a dreadful form of expression."
Starck, who is known for his interior design of hotels and Eurostar trains and mass consumption objects ranging from chairs to tooth brushes and lemon juice squeezers, went on to say that he believed that design on the whole was dead.
"In future there will be no more designers. The designers of the future will be the personal coach, the gym trainer, the diet consultant," he said.
Starck said the only objects that he still felt attached to were "a pillow perhaps and a good mattress." But the thing one needs most, he added, was the "ability to love".It seems Philippe Starck has made enough toothbrushes, toasters, watches, mopeds, chairs, trendy hotels, mediocre sushi restaurants and piles of money. So what is this shamelessly self promoting product designer doing now to get attention? Biting the hand that feeds him of course. In a recent interview with Germany’s Die Zeit Magazine, Mr. Starck proclaims the “death of design.” No longer satisfied with his life’s work and feeling that everything he ever designed was ” unnecessary”, the close to retiring designer wants to rain on everyone else’s design parade and create nothing but controversy. While I do agree with him that all he “created is absolutely useless”, I do have to argue his point that “design is dead.” There are countless designers (amateur and professional) delivering and working on products that enhance life, bring joy and make this world a little easier to deal with for people in all walks of life. Yes, there are many more designers working on mostly frivolous items we feature daily on Yanko Design, but those designs seem to just inspire us and push design further and into the mainstream consciousness of the world. Good design is always better than bad design, no matter the usefulness of any object. In his defense, if I spent an entire lifetime making objects of frivolity, I might be inclined to be introspective as well. Donate your money to worthy charities, help the helpless or lecture on the importance of environmentally sustainable, life enhancing objects, just don’t claim design to be dead and expect to exonerate yourself from the life you designed for yourself. Design is no where near dead, it just may be dead in Mr. Starck.
